Police Hearing Decision Axed By Court Of Appeal

The Ontario Court of Appeal has turned over a previous decision to keep a high profile police service act hearing behind closed doors.

In the court’s finding released on December 27th, the court decided to set aside the judgement of a previous judge to order a closed hearing and “will now remit the matter for reconsideration.”

The Ontario Independent Police Review Director found there were reasonable grounds to believe that Thunder Bay Police Service officers were guilty of misconduct and the hearing into whether police will face disciplinary action over their investigative practices will take place at a future date.

Retired judge Lee Ferrier will now have another opportunity to decide whether this hearing will be open to the public or not.

The hearing is involving officers who investigated the death of Stacy DeBungee in the fall of 2015.
