Court Battle Involving Former Tbaytel Employee Ends

The Supreme Court of Canada says it will not hear the case of a Thunder Bay woman who used to be employed with Tbaytel.

Two lower courts had sided with Linda Colistro’s contention of constructive dismissal by Tbaytel in 2007 but dismissed her action for intentional infliction of mental suffering.

She was awarded just over $114,000 in damages, but at the same time was ordered to pay $200,000 in court costs to Tbaytel and the City of Thunder Bay.

That was then appealed to the high court.

As is the usual practice, the Supreme Court justices did not give a reason for the dismissal.

In a statement to our newsroom, Tbaytel said: “we feel that the courts took a measured approach to reaching a decision.”

The lawyer for Linda Colistro has not returned our call for comment.
