Judgement Favours Justice Patrick Smith

A Federal Court has vindicated Thunder Bay Justice Patrick Smith after accusations from the Canadian Judicial Council

The Council had said Smith was wrong to accept a temporary dean’s position at the Lakehead University’s law school in 2018.

The Council is a federal body which oversees federal judges.

Smith’s lawyer Brian Gover says the Federal Court concluded the Council’s conclusion was “unreasonable” and has set it aside.

Gover added the Court also found that from the outset, the Council misused its process in pursuing disciplinary proceedings against Justice Smith.

Gover is calling on the Canadian Judicial Council “to stop wasting taxpayers’ money in its ill-conceived pursuit of Justice Smith, and to accept this decision and announce that it will not appeal. I also call upon the Council to apologize to Justice Smith.”
