Distracted Driving Law Clarified

The story of a British Columbia driver who was fine $368 for having a cell phone visible in a cup holder is going viral.

However, Constable Mark Cattani tells us the Thunder Bay police would not fine drivers here for something like that.

He says “if we take the story at face value, it wouldn’t be an offense here.”

The Ontario law states you must be holding or physically using the phone while driving.

The city police spokesperson explains most distracted driving offenses in Thunder Bay involve texting.

Cattani explains it could be the result of being able to talk on your phone hands-free.
