The Court of Appeal for Ontario has dismissed CN’s request to stay the court’s order made in June for the company to reopen the James Street Bridge for vehicle traffic.
Mayor Keith Hobbs says “the court is clear that CN must fix its bridge now.”
The Court of Appeal ruled in favour of the City in June of 2018 and ordered CN to reopen its bridge to all traffic including cars and trucks.
The ruling claimed CN is fully responsible for its bridge according to the 1906 agreement.
It is expected that the Supreme Court of Canada will issue a decision sometime in early 2019 on CN’s appeal application.
CN tells us they continue to assess the various options to comply with the Court of Appeal’s reversal of the initial order. However, they believe the Supreme Court’s guidance is still required to fully assess the extent of its obligations.
