The City of Thunder Bay has made its first comment on the pinhole leaks in copper piping.
In a statement of defense, the city is denying its acts or omissions caused or contributed to the presence of pinhole leaks in the PR Cook Apartments on Carrie Street which are owned by St. Joseph’s Care Group.
St. Joe’s is seeking $350,000 for the water damages from the city claiming it was the introduction of sodium hydroxide which caused the issue.
For its part, the city denies that its acts or omissions caused or contributed to the presence of pinhole leaks in the plaintiff’s copper water pipes.
The statement of claim adds “As such, if the plaintiff has suffered damages as alleged, which is not admitted but denied, then such damages would have accrued as a result of the plaintiff’s own negligence and/or failure to maintain, inspect, monitor or replace its copper water pipes and/or related infrastructure.”
Meantime, in a separate legal action, hundreds of homeowners in the city have launched a $350 million suit against the city over the same issue.
None of the accusations have been proven in court.
