The Ministry of the Attorney General is denying claims in a civil lawsuit brought by a former Thunder Bay Crown Attorney.
Dan Mitchell filed the almost $2 million suit earlier this year against the province of Ontario. He alleged he was unnecessarily suspended pending an investigation into sexual harassment and general harassment complaints from 2014, 2016, and 2017 involving a female lawyer working in the Crown Attorney office.
Now, the government is rebuking claims by Mitchell stating he wasn’t discriminated against on the grounds of age, or sex.
They also say he is not entitled to any of the relief he claims.
In a Statement of Defence, the Ministry states Mitchell became medically unable to work while he was on a paid administrative suspension.
They go on to say he voluntarily chose to retire after having exhausted his short-term sick days and vacation time.
No date has been set for the suit to be heard in court and the allegations have yet to be proven.
